Labeling handmade soap in the United States requires navigating the complex regulatory boundary between a true soap and a cosmetic. To meet the FDA definition of true soap, the product must be composed primarily of alkali salts of fatty acids, its cleaning properties must come entirely from those salts, and it must be marketed solely for cleansing.
True soap is exempt from FDA cosmetic regulations and is instead regulated by the Consumer Product Safety Commission (CPSC).
If the product meets the strict definition of true soap and makes no cosmetic claims, the CPSC does not legally require an ingredient list, though it is highly recommended for consumer safety.
Making claims that a soap moisturizes, heals, or treats skin conditions classifies it as a cosmetic or a drug, moving it under FDA jurisdiction and mandating complete INCI ingredient labeling.
